A former Morongo Basin Sheriff’s deputy, accused of having sex with female inmates, agreed to a plea bargain earlier this month. Brian Derryberry, who was 24 years old and the married father of a 1-year-old boy at the time of his arrest in July 2016, pleaded guilty December 4 to nine counts of having sex with inmates. Sheriff’s investigators received a tip in July 2016 that Derryberry had been having a sexual relationship with a woman in the jail, and he was arrested and fired by the Sheriff’s department a week later. He has been out on a $50,000 bail bond and working as a real estate agent since then. Under the terms of the plea agreement, Derryberry was sentenced December 4 to 35 years in state prison, but he is allowed to stay out of prison until a second sentencing hearing on February 1. Assuming that Derryberry keeps his second court date and is not arrested again in the meantime, the judge will dismiss the nine charges and the 35-year sentence, and Brian Derryberry will plead guilty to one count of sodomy and one count of making a criminal threat, and be sentenced to two years in state prison. Derryberry had been a San Bernardino County Sheriff’s deputy for two years at the time of his arrest.
